Backstory: I (Nicole Schuyler Kapuscinski) purchased my forever home between June 05, 2019 to July 2-4, 2019.
​
The property was 1.47 acres separated by a fence.
I personally liked the split feature. I didn't realize until much later that people can sale properties with issues without having all the legalities hashed out. The Real Estate Industry in Indiana should really be ashamed of themselves when it comes to what they can do to NEW homebuyers.
​
Dec 15ish, 2019: 5 months after moving in the neighbors who own the properties around ours showed up. They said they were up here visiting on vacation and wanted to check on their properties. They made unsubstantiated false claims that there was absolutely no evidence of other than the fence. Supposedly the Hodson's did not know that they sold the entire 1.47 acres in 2004 (negligence).

The Hodson's were supposed to return to their home in Byrdstown Tennessee to search for their Deed to my half acre. The Deed never existed. I received a copy of the 2004 Deed in January 2020. It showed both Kenneth and Cathy Hodson's signatures and the signature of the land pirate and inheritance hijacker ex attorney Steven Schuyler.

The Hodson's were also supposed to get back to me sooner than later to confirm their story. 3-4 months went by and not once did either Hodson contact me. Instead, they hired third party proxies to legally attempt to steal my half acre by way of Squatter's Rights a.k.a. adverse possession whether they met the Indiana Code criteria for it or not.
​
2 things happened. Many crimes were committed in a 20-year period (White Collar Crimes). Not once did Kenneth Hodson or Cathy Hodson act like they were victims. Not once did Kenneth Hodson correct Cathy Hodson when she said they lived in Byrdstown, TN 12/2019. No matter how many times it was proved they did not own my half acre and would not be getting possession back they did not stop harassing me through the Madison County Court System.

The Hodson's used a 2004 Real Estate False Advertisement in 2020 (exhibit A9). Due to inadequate laws in Indiana, there will be no charges. There is no such thing as fraud time clocks either. In my opinion the "fraud time clock" started ticking again once the Hodson's played the 2004 False Advertisement again in 2020 as proof of claim.

I would NOT know about Kenneth Hodson's Election Crimes if it weren't for the Hodson's forcing me into watching them break the law several times in a short period of time. Mind you this started during the lockdown April 2020. Kenneth Hodson literally hired someone to demand me to vacate my 1.47 acres (because it was not split properly) during a mandatory lockdown at the start of the 2020 Pandemic.

Despite popular opinion I cannot tell one story without telling the other. The documents proving crimes were committed, were attached to the land dispute case. I was so naive and clueless to how the world really worked in 2020 even though I am a Combat Veteran.

It took me several years during the Pandemic to figure out how to file an Election Complaint or Grievance. In June of 2022 I filed my first round of election complaints. The S.O.S. Holli Sullivan, and the Madison County Election Board - Russ Willis were very aware of my claims.
The Herald Bulletin has written a couple articles about the Hodson vs. Kapuscinski story (exhibit H9-18). The Jean Chaile Herald Bulletin articles (D 2-10, F1) included Hodson's response to my complaint. Every time I heard the story it would be changed or adapted to a better defense as if they were trying to cover up FACTS.
​
I am not sure why Republican Party Chair for Madison County and the Madison County Election Board chairman Russ Willis took it upon himself to decide that my complaint had nothing to do with Election Crimes when I can prove it does (exhibit F2-10, G 1-12). I still have copies of all the information/documentation because it's my facts to defend myself from Kenneth Hodson calling me a thief since April 2020 Demand Letter Exhibit C1 from April 2020.

NOTE that the date on the demand letter was 2 days before Kenneth Hodson started his campaign for the ACS Board of Trustees. Exhibit C4 is the CFA 4 form used as campaign financials and states his campaign started 2 days after the attorney Richard Fisher demanded me to vacate my home. Equally note Kenneth Hodson was not registered to vote until after July 2020. Hodson also didn't vote in Madison County from 2015-2020.

​The saddest part of all is deep down I knew I was right all along about Hodson's Residency & Timeline. I didn't know how to request candidate or a politician's voting history till August 2024, and I was given bad counsel about it. So WE figured Kenneth & Cathy Hodson would drive up here to vote so I didn't push the issue. I have been begging for help from local officials in Madison County since all this started back in 2020. 4 years is too long to be ignored by Indiana.
I finally figured out how to request Kenneth Hodson's voting history in August 2024. Voter Registration (Russ Willis) blew me off for two and a half plus years, and the County Attorney was dragging his feet releasing the info. Kristopher Bilbrey with the Political Spotlight helped get me the voting history of Kennth Hodson on 09/11/2024 (exhibit I 8)

Investigating alleged election law violations is a two step process first CEB can investigate state election law violations if it finds there is substantial reason to believe an election law violation has occurred:
If CEB finds, BY MAJORITY VOTE, that there is substantial reason to believe an election law violation occurred then CEB must: HOLD A HEARING, PROVIDE NOTICE to INDIVIDUALS THAT FILED COMPLAINT AND PERSONS ALLEGED TO HAVE COMMITTED VIOLATION, Give OPPORTUNITY to be HEARD to party alleged to have or about to violate state election law.
If in judgment of CEB a person has engaged or is about to engage in a violation of election law the CEB may take appropriate action to stop violation from occurring.
This includes referring matters to the prosecutor if an election crime.

It is absolutely unfair to allow some Candidates and Voters to break Indiana Codes, but then hold other Candidates to those same codes. If the Indiana Codes are being enforced then Russ Willis should be able to quote those codes since it’s part of his job description. If Russ Willis can not perform his duties as a Republican Chair, The Madison County Election Board, Weights and Measures, plus whatever other position he has obtained over the years then he should step down and let someone else step up to the position who can do the job.
